KCAA Tightens Noose on Drone Operators

The Kenya Civil Aviation Authority (KCAA) is tightening the noose for drone operators in Kenya. Members of the National Assembly will determine whether the regulatory bill presented to them by the Aviation Authority goes through or not.

Among other things, the regulations mandate drone operators to get written consent before using imaging devices to conduct surveillance on or take a person’s image.

On a brighter side, though, the Civil Aviation (Unmanned Aircraft Systems) Regulations, 2019, allow the operation of imaging devices on drones provided they are used in search and recue missions, and mapping and evaluating the earth’s surface. However, they still need to get approvals from KCAA, as well as comply to privacy laws.

Furthermore, failure to adhere to the rules may attract a KSh 2 million fine or imprisonment for a term not exceeding three years, or both.
